FordPass Performance Privacy Policy

SUMMARY

It’s important to understand that FordPass Performance relies on data from you, your mobile device, and your vehicle, such as Vehicle Location and Driving Data (which is called “Telemetry Data” in the mobile app and infotainment screen experiences), all of which allow us to deliver great services and features for your off-road or track adventures, as well as communications tailored to your interests. We may share this data, including with our affiliates, as described below.

This Privacy Policy (“Policy”) is for the FordPass Performance mobile app. FordPass Performance is offered to users by Ford Motor Company, One American Road, Dearborn, Michigan 48126 United States of America.

This Policy applies to the personal information we collect through your use of the FordPass Performance mobile app.

It covers Ford Motor Company and its controlled affiliates and subsidiaries (“Ford,” “we,” or “us”) that use the personal information collected through your use of the FordPass Performance mobile app.

This Policy supplements the Ford Motor Company Privacy Policy, which further describes how we collect, use, and share personal information (including Connected Vehicle Information) and describes the privacy rights of California residents as of January 1, 2020.  Please visit https://www.ford.com/help/privacy/ for more information.

United States Only.  This Privacy Policy applies to the collection, use, and sharing of personal information only of individuals in the United States.

This Policy does not apply to:

  • Other products, services, features, websites, mobile apps, platforms, or properties that Ford owns or operates and that display, link to, or refer to their own privacy policies;
  • The data practices of anyone other than Ford; or
  • Content, products, services, features, websites, mobile apps, platforms, or properties that Ford doesn’t own or operate, as described in the section “Other Services” below.

1. Vehicle Connectivity

FordPass Performance relies on AppLink® technology to connect the app with the in-vehicle SYNC® system, and you will be prompted to set up AppLink® (also called “MobileApps” in the SYNC® system) if you have not already done so. Your mobile device provides the data connection (so data charges may apply), and Apple CarPlay® or Android Auto provides the infotainment integration (depending on your mobile device’s operating system). 2. Categories and Sources of Personal Information

We collect the following types of information through your use of FordPass Performance:

Information You Provide.  When you use FordPass Performance, you will be asked or given the option to provide information to us, such as:

  • Security: when you log into FordPass Performance, you provide the email/username and password for your Ford account. If you don’t have a Ford account, you will be prompted to create an account the first time you sign into FordPass Performance, and you will provide an email/username and a password for your Ford account. You can use these credentials to sign into other Ford experiences (if supported). If you already have a Ford account, your log in information will also be used during the FordPass Performance set up process to retrieve the VIN for each vehicle associated with you that is eligible for use with FordPass Performance.
  • Contact Information: if you create a Ford account as part of your sign-in experience for FordPass Performance, you will provide your name and email/username. Your full name will appear in your FordPass Performance profile, and you can also add a nickname.
  • Preferences: if you have more than one eligible vehicle, you can choose your FordPass Performance experience based on the vehicle type. You can choose which name (your full name or nickname) you wish to display to the FordPass Performance community or, if you choose to share your FordPass Performance adventures on social media, in your social media posts. You can also select your audio, video, and telemetry data recording preferences and your preferred measurement system (imperial or metric). You can indicate your in-app messaging or notification preferences, as well as your preferred communication method, and language.
  • Audio/Visual: adding a photo for your FordPass Performance profile or uploading photos from one of your off-road or track adventures. Your profile photo and any photos from your off-road or track adventures that you add to FordPass Performance will also be visible to other FordPass Performance users. If you choose to record and save audio or video of your drives, the audio and video recordings will be saved only to your mobile device.
  • Content of Communications: your communications with us, such as emails, customer service or technical help requests, feedback, or survey responses. We will also collect information you provide when you use or interact with different FordPass Performance features and services, such as search or filter parameters, trails or tracks you choose to download or mark as favorites, and ratings or other information you add about trails or tracks.

When you are asked to provide information, you may decline to do so (for example, by not adding a photo or rating a trail). In many cases, you can choose to provide information or not. Some FordPass Performance features or services, however, may not function correctly or be available for use if you choose not to provide necessary information.

Information From Your Mobile Device.  We automatically collect some information from your mobile device when you use FordPass Performance:

  • Device Details and Network Information: we collect information about your mobile device, such as the operating system it uses, which versions of the operating system and FordPass Performance your device is running, unique device identifiers (for example, your mobile device ID and/or MAC address), and mobile network information.
  • Digital Activity: we collect information about how you use FordPass Performance or third-party services that integrate with FordPass Performance, such as which features or services are used and how often or how long they are used. We may also use technologies that collect information about how FordPass Performance is performing, including if it crashes. The information collected through these technologies may be connected to other information we have about you, including information about your activity across other Ford mobile apps or websites over time.
    • These technologies may include cookies (small files that are stored on your computer or device), tags, pixels, or web beacons (small pieces of code placed on web pages and content that communicate when the page or content has been viewed), log data (logs created that may include IP address, date and time of activity, and the website or location that referred you to FordPass Performance), or third-party analytics tools, such as Adobe Analytics, Amplitude, Aptelligent, and DynaTrace).
    • Some of these technologies can be limited or deactivated through your browser or device settings, but some cannot. FordPass Performance does not respond to “Do-Not-Track” requests. FordPass Performance does not track your activity across other companies’ mobile apps or websites.

  • Device and Mobile Location: if you have enabled location services on your mobile device or granted FordPass Performance permission to collect the location of your mobile device, precise GPS location will be collected when you are using location-based features or services in FordPass Performance.

Information From Your Vehicle.  If you choose to record and save your drives, FordPass Performance will collect data about how the vehicle is performing, how it is driven, where it is located, and the environment in which it is operated, using the vehicle connectivity technology described above. You can choose your recording preferences in the FordPass Performance app, in the “Settings” menu. Saved recordings of telemetry data (which include Driving Data and Vehicle Location) will be linked to the vehicle’s unique identification number (“VIN”) a unique FordPass Performance app identifier we generate, and/or other identifiers.

When a drive is recorded and saved, the following data can be associated with you:

  • Vehicle Data: information about the status, performance, and diagnostics of the vehicle and its systems, parts, and components, such as tire pressure, oil pressure, fuel and fluid levels, and fluid temperatures. We also collect information about the environment in which the vehicle is operated, such as outside air temperature.
  • Driving Data: information about how the vehicle is operated and used (such as speed, use of accelerator, brakes, steering, and engine RPM, etc.). This information may be referred to in the vehicle as “Driving Characteristics Data.”
  • Vehicle Location: the precise GPS location of the vehicle when it is turned on and you are using location-based features or services in FordPass Performance. The approximate or precise location of the vehicle may also be derived from other information, such as travel direction, speed, the distance or duration of your recorded drive, location information about the trails or tracks you drive on, etc.

Please be aware that data may be collected from the vehicle separate from your use of FordPass Performance. Whether data is collected depends on what connectivity technologies, software version, data sharing settings, and Connected Services are present and what selections have been made for the data sharing settings. Information We Generate About You.  We generate new information from the data we collect. For example:

  • Identifiers We Generate: we generate unique identifiers associated with you or your mobile device, including your Ford account identifier and your FordPass Performance app identifier. The unique identifiers help us identify you or associate your information to you.

Information From Other Sources. In connection with your use of FordPass Performance and other Ford products, features, and services, we obtain information from others when you direct them to share information with us and from the following sources:

  • Service Providers, Suppliers, and Agents: from our vendors, suppliers, or agents working on our behalf, we may receive Contact Information, identifiers, information about your use of the features or services they support, etc.

To support our compliance with valid inquiries and directives from law enforcement or other government agencies; to act under exigent circumstances to help prevent the loss of life or serious injury or to protect the personal safety of Ford or affiliate personnel, users of our vehicles, websites, or mobile apps, our visitors, or the public; and to protect the rights or property of others.

In carrying out these purposes and in order to give you a more seamless, consistent, and personalized experience, we may combine personal information we collect in connection with your use of FordPass Performance with information that we have collected through your use of, or interaction with, other Ford products, features, services, or experiences, and/or with information that we have collected from other sources.

Finally, we may de-identify information we collect about you and use it for any purpose in accordance with applicable law.

4. Our Sharing of Personal Information

We share the personal information collected in connection with your use of FordPass Performance with your consent, when you direct us to share it with others, as necessary to complete your transactions, or to provide the products, features, services, or experiences you have requested or authorized. In addition:

  • Affiliates: we share the personal information collected in connection with your use of FordPass Performance among the companies within the Ford Motor Company family of companies and affiliates. Our “family of companies” is the group of companies related to us by common control or ownership. Information is shared within this “family” as a normal part of conducting business operations and offering products, features, and services to our customers.
  • Service Providers, Suppliers, and Agents: we share the personal information collected in connection with your use of FordPass Performance with our vendors, suppliers, and agents working on our behalf for the purposes described in this Policy. We require them to use it only to perform that work for us and to use adequate safeguards to protect the confidentiality of the personal information they receive. For example, companies we've hired to provide customer service or technical support, or to support some of the features in FordPass Performance, may need the personal information to provide those functions.
  • Law Enforcement Agencies, Courts, Regulatory Agencies, and Others: we will share the personal information collected in connection with your use of FordPass Performance when we believe that doing so is necessary to:
    • comply with applicable law or respond to valid legal process, including from law enforcement or other government agencies;
    • act under exigent circumstances to help prevent the loss of life or serious injury or to protect the personal safety of Ford or affiliate personnel, users of our vehicles, websites, or mobile apps, our visitors, or the public;  
    • detect, investigate, prevent, or otherwise address fraud or privacy issues;
    • operate and maintain the security of our products, including to detect, investigate, prevent, stop, or remediate an attack on our computer systems or networks; or
    • protect the rights or property of ourselves, our affiliates, or others, including by enforcing our agreements, terms, and policies.
  • Parties to Corporate Transactions: we may also share the personal information collected in connection with your use of FordPass Performance as part of a corporate transaction or proceeding such as a merger, financing, acquisition, bankruptcy, dissolution, or at transfer, divestiture, or sale of all or a portion of our business or assets.

Finally, we may share de-identified information in accordance with applicable law.

5. Your Sharing of Personal Information with Others

You may choose to share information about your FordPass Performance adventures with other users of FordPass Performance, social media platforms, and other third parties, such as information about the trails or tracks (including photos and ratings), recordings of your drives (including audio, video, and/or telemetry data, including Vehicle Location), your interactions with other FordPass Performance participants (including comments and likes), etc. Any information you share may identify you or be capable of being linked to you.

If you choose to share information about your FordPass Performance adventures with others, once you have shared it, this Privacy Policy does not apply to any of the shared information.

6. Integration with Other Services

FordPass Performance may integrate with, or contain links to, other products, services, features, websites, mobile apps, platforms, or properties that Ford owns or operates and that display or refer to their own privacy policies (“Other Ford Services”). Those privacy policies apply to the Other Ford Services, but this Policy does not.

FordPass Performance may also integrate with, or contain links to, other content, products, services, features, websites, mobile apps, platforms, or properties that Ford doesn’t own or operate (“Other Non-Ford Services”) even if they look similar to ours. Please be aware that Ford is not responsible for any Other Sites, their content or operation, or the privacy policies or data practices of the third parties that offer them, even if you access them via FordPass Performance. 7. Security and Retention of Your Personal Information

Safeguarding personal information is important to us. While no systems, applications, or websites are 100% secure, we take reasonable and appropriate steps to help protect personal information from unauthorized access, use, disclosure, alteration, and destruction.

To help us protect personal information, we request that you use a strong password for your Ford account and never share it with anyone or use the same password with other mobile apps, websites, or accounts.

8. California Privacy Rights

California Consumer Privacy Act (CCPA): if you are a California resident and the processing of personal information about you is subject to the CCPA, you have certain rights with respect to that information. California Shine the Light: under California’s “Shine the Light” law, California residents who provide personal information in obtaining products or services for personal, family, or household use are entitled to request and obtain from us once a calendar year information about the customer information we shared, if any, with other businesses for their own direct marketing uses. California Business and Professions Code Section 22581: California residents under the age of 18 who are registered users of online sites, services, or applications have a right under California Business and Professions Code Section 22581 to remove, or request and obtain removal of, content or information they have publicly posted. 9. Changes to This Privacy Policy

We will update this Privacy Policy when necessary to reflect changes in our products, services, or features, how we use personal information, or the applicable law. When we post changes to the Policy, we will change the date at the top of the Policy.

If we make material changes to the Policy, we will provide notice or obtain consent regarding such changes as may be required by law.

This Privacy Policy was first effective as of the date indicated at the top of the Policy.
